Should I let the Bank Foreclose?

A lot of people are “upside down” in their home right now and owe more than what it is worth. I’ve been getting this question a lot lately, “Should I just walk away from my home and just let the bank have it back?” Well, there are some serious consequences you need to consider first. I’ll try and write this in easy to understand terms.
If you just walk away from your home the bank will conduct what is called a ”foreclosure” on your property. There are a couple of problems with this that can have a very negative effect on your life. First, once you are late making your payment (typically the 15th of the month), you are in default. Once you are as little as 30 days late, the lender can start the foreclosure process. Georgia is a Non judicial state which means the lender can foreclose quickly without going to court. Now the lender (bank) will list your home in the newspaper for 30 days notifying of the pending auction on the court house steps. When the bank sells your property on the courthouse steps it will bring significantly less than what you owed on the note (mortgage). This is where you come in. The lender can now come after you for the deficiency, and this can lead to a judgment against your wages and all kinds of harassing phone calls and letters.
Secondly, a foreclosure will totally screw up your credit. You can pretty much forget about purchasing anything on credit. Clothing, or much needed appliances and even cars. If you do find what they call a “hard money lender” in the business to give you a loan on a car, they will charge you a ridiculously high rate! And what I think is most important, it will also keep you from purchasing another home for at least 5 years.
There are a lot better options out there than letting your home go into foreclosure. You can talk to the lender and try to renegotiate or modify your loan, but unfortunately, the loan modification programs have been relatively ineffective. One of the most effective options we see now is a “short sale”. There are even investors who will purchase your home on an “option”. Whatever your situation, don’t despair, your situation is not hopeless, and don’t just “walk away” from your home and face foreclosure.
